Whaledad, in all fairness, your response, in this case, seems a bit
harsh, although I appreciate your frustration with the pump/dump
traffic overwhelming the boards.  So it begs the question, where is
*your* evidence that "share prices being pumped up by spam in
unrelated newsgroups...".  There's no particular news on thousands of
companies, that does not by default make one post on one of them a
pump/dump fraud.  I did not see any "pumping" in his post; if
anything, CNN is pumping IMGG, report them to the SEC, better yet, to
FINRA.  So if this is pumping, I'll grab the pump handle - ever heard
of OPTT?  One of the "greenest" companies on the planet, sure to be a
winner in years to come, as "green-tech" takes hold.  If you check the
stock, be sure to follow through and visit their site.  The stock
trades a bit volatile, as I believe it is heavily day-traded, which

You are wrong on all counts:

When CNN reports on a company (unless they would do it based on being
paid to do so by the company or on or more of its shareholders, or
based on false information) they are just doing their job.
When Gup posts a link to the CNN report in several completely
unrelated newsgroups (highly likely because he owns that stock) he's
committing pump-and-dump fraud.

Note: "On October 6, 2009, Imaging3, Inc. (the "Company") completed a
series of private placements of its common stock pursuant to which the
Company sold a total of 107,059,027 shares of its common stock at a
purchase price of $0.025 per share raising total capital of
$2,676,475.68. The private placements were made pursuant to Rue 506 of
Regulation D promulgated under Section 4(2) of the Securities Act of
1933, as amended." These "private placement owners" are lookign for
ways to sell that stock at a good profit. And form the looks of it,
they are succeeding. While the company is reporting a whoping -400%
return on invested capital.

If you are promoting OPTT (net profit margin -450% for the year) in an
HPQ newsgroup - without any other reason than that you own the stock -
you too are committing pump-and-dump fraud.

Whaledad, me thinks you take yourself a bit too seriously.  First I
never said or implied that I own the stock, so there's no inherent
forbearance, preponderance or intent to pump-and-dump.  Second, by
implication, pump-and-dump is relegated to a short time frame, days or
weeks at best; note that I stated, "sure to be a winner in years to
come" - that's called an opinion.  Third, the SEC could give a rats
ass about such a penny-ante case, if it were even to be labeled as
such.  Last I checked there's no laws prohibiting citizens from
posting an opinion in a public forum.  So please, fulfill your dreams
and report everyone with an opinion.  I'm certain they'll be pounding
the door down in a matter of days; hell, I'll probably be sharing a
cell with Madoff before year's end.  Until you can cite statute,
