I agree with this post's sentiment.  Get out now!  It will not get any
better.  Lone Star's new offer is $8.50.  Currently trading around
$8.70.

All of you have been warned time and time again that Greed leads to
disaster when investing.

1. No case is airtight

2. You don't know what Lonestar may claim in court regarding the
questionable accounting practices at LEND; Does anyone remember the
Auditor resigning?

3. 8.50 is the easy out for Accredited, I'm certain Lonestar knows
something and may be tipping their cards to LEND.

4. Should Accredited lose, you lose everything. Make $4 additional per
share? or lose it all? You sell now maybe you don't make the
additional here, instead you move your money into another company that
won't be so News Driven

Take your pick, I don't own the stock and never would, I know the
company pretty well and I would advise walking away.

Good Luck

I see that you bought puts. You are the one that needs the luck. The
only way that Lone Star can back out now, is if there is a higher
offer by someone else. They severely damaged their case with this
counter offer.

Exactly, now that they made an offer for 8.5 in the current situation,
it cant go under that. its not a loose everything situation. If the
trial goes against LEND, and Lonestar is not forced, they still have
to buy at 8.5. That is 50 cents higher than where it is now.

The betting is: 8.50 deal, you loose 50 cents.
15.10 deal,... you make 6$.

not looking bad.. not bad at all.

There is no way they could cancel the 8.5$ offer now, since it has
been made after al the resignations, firing of ppl, etc..

They already rejected the $8.50 offer.  So if LEND does not win, this
stock will nearly be worthless.  Read the above post on greed.  I'll
take the profit now, the sure profit, rather than wait on a court
case.  No one can say for sure what will happen in court, regardless
of the 'strong case'.  Good luck, but when a 50% gain is looking in
your face after 2 weeks, what more could you want??

Rick, you must be really short to be so ofuscated and try to confuse
people that are long.
Even if the board Rejects/Opposes to the new take over, its the
shareholders that vote that counts, so the deal can perfectly go
through and is still valid at 8.50, with the 15.1 still valid aswell.

The board has far less than 50% of the shares under control, therefore
it is not their choice weather the 8.50 deal is going to go through or
not, if the 15.1 deal does not go through.

The board knows the court chances pretty well, so if they reject it,
it is very likely that Delaware will make Lonestar buy LEND.

I would expect Lonstar to present a 12$ offer at least in the next
weeks to put some more pressure, but I cant feel any worried now with
Lonestar shares.

In the interest of Full Disclosure I have neither bought Puts nor am I
short on this stock in anyway. I am just worried about the little guy
getting squeezed, like he did in 2001.

Furthermore, there is no Damage to your case by making an offer, they
basically gave LEND an easy out. It is similar to a DA making a Plea
Agreement.

All I'm saying is that no one makes a $400 mil play without a fine
print loophole, Lonestar will show their cards at trial and we'll see
what the outcome is.

supposedly 70% of common stock has been tendered.
Accredited never presented any misinformation about the material
actions within the company, on the contrary, they were pro-active
about all press releases and SEC filings regarding their detraction of
operations.
LEND's auditor claimed industry wide turmoil as the reason for
resigning, not any problematic accounting by Accrdited. this was still
prior to the merger agreement.
Lonestar was well aware of industry and market-wide events before the
agreement, during the tender period, and now within the extensions and
the Lonestar amended offer.
This deal is iron.

Lonestar's bid to get an even lower price on the acquisition is only
to get more action out of this stock. They've probably squeezed the
shorts enough in the last 3 weeks to buy Lend for 400 mill with just
their returns. They won't go to court.
They'll settle with LEND to consummate the agreement. End of
September= end of Q3 = right on schedule.

- this is coming from the guy who told you Lonestar was making a bid
for a lower purchase price. It's still a race against Bankruptcy, but
since trimming the workforce and closing the retail ops, LEND has
enough liquid to wait this out until Q2 2008.

I tendered my shares and will wait my 12.50-15.10 buyout, but i should
have kept playing this puppy as its still on the field. BUY
