  I think the article in question simply highlights the fact that the &lt;br&gt; issue of software patents is complicated. If you look at the history &lt;br&gt; of SP court decisions (wikipedia is one great source), you will see &lt;br&gt; that it is full of conflicting decisions. &lt;br&gt; &lt;p&gt;Validity issues aside, I think it is a good idea to separate the issue
