    据上海法院公开的信息显示,上海第九城市于近日第三次将暴雪公司告上法庭,此前九城已经对暴雪公司分别提起财产损害侵权和商业诋毁侵权两起诉
讼。

      DoNews 6月2日消息(记者 王乐)据上海法院公开的信息显示,上海第九城市于近日第三次将暴雪公司告上法庭,此前九城已经对暴雪公
司分别提起财产损害侵权和商业诋毁侵权两起诉讼。

             根据上海法院的公开信息显示,上海市一中院已经受理了九城诉暴雪娱乐、暴雪软件的“侵犯计算机软件著作权纠纷”,案号
为“(2009)沪一中民五(知)初字第125号”。

            公开的信息还显示,该案的开庭时间为2009年7月08日14:00分,正好与九城暴雪另一起“商业诋毁纠纷”同时,同地(上
海市一中院第三十五法庭),同一名法官进行。

            有法律界人士分析,九城对暴雪提起“软件著作权”可能是主张对《魔兽世界》游戏相关的翻译权利,但这种权利一般在合同中应该有
所约定。

            据了解,在网易公司发表有关“网易版魔兽世界的翻译将得到加强”等言论后,署名为九城“魔兽世界”汉化工程师的人曾在魔兽世界
论坛发帖称,九城公司已经完成了包括wlk在内的汉化工作,应该享有其著作权。

           目前暴雪和九城均未对此发表评论。(完)

這很正常, 用常理來判斷就知道了, 先前九城的利空盡出,
成交量的萎縮也可以證明該賣或是想賣的人都已經離手了.
在股價低於公司現值的情況下, 唯一讓大家卻步的原因就是---信心問題.

信心問題在於:

(1) 九城在失去魔獸後, 90%營收要由什麼來填補
(2) 新的遊戲 FIFA online 2 是否可以替九城帶來及時雨, 解決燃眉之急
(3) 競舞團2是否可以延續1代的光芒. 繼續替九城帶來利潤
(4) 名將三國遲遲未推出, 是技術問題?還是?

今天的漲勢無疑的代表了市場對於九城最新訴訟的信心, 以及對防惡意收購的回應
以上只是我個人的看法, 歡迎大家討論

i think Blizzard and Netease.com have to pay between 20-50 Mio. $ to
compensate translation for Wrath of the Lich King. The9 had a contract
to publish the 2nd add-on in china, but never get it..anyways, the
only chance for The9 is to survive is a merger with 9you or Kingsoft
Gaming and to do a second IPO after merger...

@china users: anyone knows how much server are actualy open for FIFA
Online 2 and does anyone have the URL for Server-List (down,
up)..thanks in advance...

well, its unclear.
First, the translation is not just the actual job of translating the
game. Their problem is that their rights were violated. This is why
the price is higher than blizz just paying the9 for the translation.
Second, even though NTES said they want to improve the translation it
doesnt really say anything about the job that was done before. They
could just be looking to customise it a bit.

But i see what you mean ksa, it seems like a very high price even
taking into account that it's hard to actually price these things.

I'm still a bit confused about the "their rights were violated" part.
Since netease doesn't have the game yet...are they claiming their
rights would be violated in the future??

I imagine it's because the contract is already signed and the deal is
done.
Since nothing can change they are claiming that their rights were
violated the second the decision was made to take the game away
without compensating them for it.

Yeah, I do think blizzard should have offered to pay the9 for prepaid
cards and tokens instead of just hanging all those customers out to
dry, I can't imagine them wanting to continue playing after all the
crap they are going through.

you're absoultely right, not to mention the 20 odd days that they now
have without a game at all and the possibility of losing data while
they change servers.
Do they reroll on another country's WoW server, or move to another
game? (i assume migration between chinese and for example korean
servers is not allowed).
Which do you think is more likely??
I think this decision has a chance of really hurting WoW numbers in
China..

An online poll by Sina.com showed that 53% of some 130,000 voters said
that they would continue with the NetEase-run WoW, while 21% would not
play anymore and 26% said they would “wait and see.” In another survey
on QQ.com, which drew more than 173,000 responses, only 35% say they
would continue playing WoW when it returns.

oh dear.. if those figures hold this could damage NTES quite a bit.
But actually play out well for NCTY since they have Atlantica and that
co-operation with Kingsofts JX Online to fill part of the void..

your right, if WoW delay further because of the lawsuites brought by
The9 and JX Online 3 starts open beta before WoW launches in China
again...

But nevertheless, i think this is the worst decision Blizzard ever
made, because this left only loosers => The9, Netease.com, Blizzard,
and last but not least the players

I agree, it was a terrible decision,
I think in theory it may be profitable for Bliz in the long run, but
the9 have played this pretty well and WoW might lose players to other
games, one problem China does not have is a shortage of MMOs to
distract yourself with.
And yeah, everyone involved lost out, but maybe if WoW totally breaks
down in China there could be greater competition between other games
and this may lead to the development of more and better games by
chinese dev studios.
It certainly has potential to be very good for the chinese games
market...
Guess we'll have to see how the court cases play out, or how much the9
get in out of court settlements.
