I have no claim to know the extent of the lawsuits... but really there
can only be so many class action lawsuits on one action.  These news
releases are the lawyers jockeying for position to be able to collect
the most takers (stock owners who fit into the class)  the more
clients that the attorneys can sign up, the more money they will make
on the case.

The SunPower management team is expected to hold a conference call mid-
month to reveal the extent of the accounting issues, and Bachman is
betting those findings will be a catalyst to a spike in the stock
price. He does not expect the stock to reach his target of $29, but he
is wagering on a recovery in the mid-20s range.

"I don't believe there is systematic fraud being perpetrated from the
top down, but a lack of control that will be revealed. But looking
backward, even at an earnings restatement, doesn't tell us the
future," Bachman said.

The plummet in SunPower shares allowed Pacific Crest to revisit the
underperform rating, in relation to the 2010 and 2011 outlook.
Bachman's review of upcoming projects led to the conclusion that there
is at least 1GW of projects that could make the SunPower 2011 story an
interesting one, and a story which he cautiously advises investors to
pursue.

"I've stuck my neck out pretty far on this one," he conceded, but he
added that it is a well-educated guess and a good investment
opportunity for investors with a high risk-reward profile.

Wonder if Sunpower can sue their auditors.  If yes, means they can
just past the legal cost to the auditors.  Financially, it would then
be Lawyer vs Auditor.  Sunpower will therefore not be distracted from
making investors rich.

I am new to stock market. Can anybody please tell me what could be the
future of this company? I bought some shares at 22.15 recently and
holding it thinking that it would go back up but I am worried to look
at all the news related to "Class Action Lawsuits" daily , any idea
how much these law suits affect a company?

5 Superball Stocks

By Rich Smith
November 23, 2009 | Comments (0)

"'Don't catch a falling knife' ... The idea of buying a former
superstar stock at a discount price certainly has its attractions, but
you've got to make sure you catch the haft -- not the blade."

So runs the thesis of my recurring Fool column "Get Ready for the
Bounce," in which we search among the wreckage of Mr. Market's
overturned cutlery drawer, hoping to find future winners in a pile of
52-week losers. But do we really need to sit around for a whole year,
waiting for a potential bouncer?

I say nay. Sometimes, stocks fall far in far less time than a year --
and like a superball dropped from the balcony, the harder they fall,
the higher they bounce. Today, we're going to look at a few equities
that've suffered dramatic drops over the past week. With a little help
from the 145,000 members of Motley Fool CAPS, we hope to find an
opportunity or two for you:

Illumina (Nasdaq: ILMN)

Sinovac Biotech (Nasdaq: SVA)

SunPower (Nasdaq: SPWRA)

greater price drops over the past week. 52-week high and recent price

Five super falls -- one superball
If you own any of the stocks named above, chances are you didn't enjoy
last week very much. From the bottom up, we saw SunPower get crushed
on news of accounting snafus, while both Sinovac and Illumina got
spanked, seemingly for no reason at all. Isis Pharmaceuticals actually
had good news, announcing successful trial results for the mipomersen
cholesterol drug it's developing in cooperation with Genzyme.

And our top-ranked stock this week? Jacobs Engineering sank under the
weight of weak sales, weaker earnings, and weakest of all -- guidance.
Predictions of 2010 earnings coming in as low as $2 missed Wall Street
expectations by a mile. So why would anyone want to own this stock,
much less give it a full, five-star rating?

Yeah, the internal auditors will work this out with the  help of the
external auditors ( PwC), readjust the books, and move on.

Simple as that, its just an 'accounting error' Way too much hype
surrounding this.

Even after the downgrade, most analysts are setting targets to $30.
That's assuming the company actually has a multi-million dollar
error.  If they don't (albeit a slim chance), then expect the price
targest to go back up.  Either way, there's a lot of upside to this
stock after the 18% drop today.  10%+ recovery in the next few days
would be a nice short-term gain.

chill out...minor accounting error that will be corrected within 30
days. Even if they did overstate by 15million, how much of an impact
is that really going to have in the longer term for this company?  not
much.

market
is over reacting, I think the best moment to load up SPWRA, is right
now, under 22.40

I bought SPWRA at the lows on Thu. from stock recommendation of an
iPhone app called "reversals" and made a little over $2,000 on
Friday.  It is a new app. for swing traders.  The app scans the market
once a day for some technical conditions, pretty simple app.  I
wouldn't buy or short every stock pick from their list but at least
gives some good ideas.  Just sharing the information, and no I'm not
pumping an app I developed.  If you know another good finance app,
please share.
